DISCLAIMER OF LIABILITY
Sewer-Medic offers drain cleaning services to its customers. By engaging our services, you ("Customer") agree to the following terms and conditions:
- Scope of Services: The Company will perform drain cleaning services with the utmost care and professionalism, using industry-standard methods and equipment.
- Limitation of Liability: While the Company strives to provide effective and safe drain cleaning services, the Customer acknowledges that plumbing systems can be complex, and unforeseen circumstances may arise. Therefore, the Company shall not be held responsible for any damages, including but not limited to property damage, personal injury, or consequential damages, resulting from or related to the drain cleaning services provided.
- Exclusions: This disclaimer of liability extends to damages caused by, but not limited to, the following:
- Pre-existing plumbing issues not identified during the service.
- Negligence or misuse of plumbing fixtures and systems by the Customer.
- Damage caused by environmental factors, such as tree roots or shifting soil.
- Any damage to landscaping, structures, or belongings in proximity to the plumbing system.
- Indemnification: The Customer agrees to indemnify and hold the Company harmless from any claims, losses, or liabilities arising from or in connection with the 7 drain cleaning services, except for claims arising from the Company's gross negligence or willful misconduct.
- Insurance: The Company maintains appropriate liability insurance coverage, but the Customer is encouraged to maintain their own homeowner's insurance or property insurance to cover any unexpected damages.
- Cancellations: The Customer has the right to cancel drain cleaning services at any time. However, any fees or costs incurred by the Company up to the point of cancellation shall be the responsibility of the Customer.
By accepting our drain cleaning services, the Customer acknowledges and accepts the terms and conditions outlined in this Disclaimer of Liability. This agreement shall be binding upon the parties and their respective heirs, executors, administrators, successors, and assigns.
